Road Attack Rally

ENGLISH

1. Nature of the Event
   The Road Attack Rally is not a competition or speed-related tour. The purpose of the rally is to drive beautiful routes together and to share automotive passion with like-minded enthusiasts.
2. Waiver of Liability
   Prior to participation, each participant (driver and co-driver) must sign a waiver of liability. By signing, the participant declares to waive any claims and agrees to these terms and conditions.
3. Insuranc
   Participants are solely responsible for taking out and holding, at the time of participation:
   – a valid car insurance policy;
   – a passenger insurance policy;
   – a personal liability insurance policy;
   – a travel insurance policy with worldwide or European coverage (depending on the route), including medical expenses and repatriation
   an insurance policy covering all personal goods brought to the rally.
4. Traffic Rules
   Participants are required to comply with all traffic laws applicable in the country where the rally takes place, including speed limits. Any violations are entirely at the participant’s own risk and responsibility.
5. Liability|
   Participation in the rally is entirely at the participant’s own risk. Car & Rally Events, the Road Attack Rally Crew, and associated venues cannot be held liable in any way for:
   – damage to vehicles;
   – loss of or damage to personal belongings;
   – personal injury or consequential damages resulting from such injury.
6. Damage Resulting from Breaches
   Any damage arising from non-compliance with these terms and/or instructions issued by the organization will be fully recovered from the participant responsible.
7. Vehicle Transport
   If vehicle transport to or from a location is arranged, only the General Transport Conditions for Motor Vehicles of the relevant transport company apply. These conditions are available upon request. Car & Rally Events cannot be held liable for any damage, loss, or costs resulting from such transport.
8. Prohibited Substances
   Driving under the influence of alcohol, drugs, intoxicating substances, or medication that may impair driving ability is strictly prohibited. Furthermore, the use of drugs or intoxicating substances is prohibited throughout the entire event.
9. Rights of the Organization
   The organization reserves the right to refuse or disqualify participants in the event of:
   – unsafe or irresponsible driving behavior;
   – antisocial or disruptive behavior;
   – failure to comply with the instructions of the organization.
10. Sponsorship Stickers
    Affixing sponsor stickers on the participating vehicle is mandatory. Participants may opt out of this obligation by paying a fee of €750 excluding VAT, to be indicated at registration. If it is determined afterwards that the sponsor stickers were not applied, the organization reserves the right to charge this fee retroactively to the participant.
11. COVID-19 Regulations
    Participants are required to comply with all local measures and regulations in relation to COVID-19.
12. Cancellation of the Event
    In the event of full or partial cancellation of the rally, regardless of the reason, Car & Rally Events cannot be held liable. Refund of the participation fee or any other incurred costs is excluded.
13. Final Authority|
    In all cases not covered by these terms, the organization’s decision is final. Participants are required to comply with all instructions issued by the organization at all times.
14. Media
    During the rally, photos and videos will be taken. Participants agree that this material may be used by the organization for publication on social media and other promotional purposes.
15. Age Requirement
    The minimum age for participation is 21 years.
16. Personal Data & Communication
    Participants agree that their personal data (such as name and contact details) may be shared by the organization with third parties directly involved in the execution of the Road Attack Rally, such as hotels, restaurants, and other visited venues, insofar as necessary for the organization of the event.
    Participants also agree that their name and phone number may be added to a WhatsApp group in which other participants are included, solely for communication and coordination purposes related to the event.
    The shared data may not be used by participants or by third parties for any other purpose, such as advertising, promotion, commercial exploitation, or personal gain.
17. Access to Events
    All events, dinners, and parties that are part of the rally are exclusively accessible to registered participants who have received a personal entry pass.
18. Cancellation by the Participant
    Cancellation is only possible up to three (3) months prior to the start date of the event. After this period, cancellation and refund of the participation fee are not possible. A deposit paid at registration will under no circumstances be refunded.
19. Payment
    If full payment of the participation fee has not been received by the specified due date, the payment obligation remains in full force and the entire amount remains payable.
20. Personal Registration
    Registrations are personal and non-transferable.

This statement of approval is valid during the Road Attack Rally organised by Car & Rally Events. By registration to the rally, the participant declares to have taken note of the rules and agrees to them.

NEDERLANDS

1. Karakter van het evenement
   De Road Attack Rally is geen wedstrijd of snelheid gerelateerde tour. Het doel van de rally is het gezamenlijk rijden van mooie routes en het delen van autoliefhebberij met gelijkgestemden.
2. Vrijwaringsclausule
   Voor deelname dient iedere deelnemer (rijder en bijrijder) vóór aanvang van de Road Attack Rally een vrijwaringsclausule te ondertekenen. Hiermee verklaart de deelnemer afstand te doen van verhaal en akkoord te gaan met deze voorwaarden.
3. Verzekeringen
   Deelnemers zijn zelf verantwoordelijk voor het afsluiten en op het moment van deelname in bezit hebben van:
   een geldige autoverzekering;
   een inzittendenverzekering;
   een persoonlijke WA-verzekering;
   een reisverzekering met wereld- of Europese dekking (afhankelijk van de route), inclusief medische kosten en repatriëring;
   een verzekering voor alle goederen waarmee men aan de rally deelneemt.
4. Verkeersregels
   Deelnemers zijn verplicht zich te houden aan de ter plaatse geldende verkeersregels, waaronder maximumsnelheden. Eventuele overtredingen zijn geheel voor eigen risico en verantwoordelijkheid.
5. Aansprakelijkheid
   Deelname aan de rally geschiedt volledig op eigen risico. De organisatie Car & Rally Events, de Road Attack Rally Crew en aangesloten locaties zijn op geen enkele wijze aansprakelijk voor:
   schade aan voertuigen;
   verlies of beschadiging van persoonlijke bezittingen;
   letselschade of gevolgschade.
6. Schade door overtredingen
   Schade die ontstaat door het niet naleven van deze voorwaarden en/of aanwijzingen van de organisatie zal volledig worden verhaald op de betreffende deelnemer.
7. Transport van voertuigen
   Wanneer gebruik wordt gemaakt van autotransport van of naar een locatie, gelden uitsluitend de Algemene Vervoercondities Motorvoertuigen van het betreffende transportbedrijf. Deze voorwaarden zijn op verzoek beschikbaar. Car & Rally Events is op geen enkele wijze aansprakelijk voor schade, verlies of kosten die voortvloeien uit het transport.
8. Verboden middelen
   Het rijden onder invloed van alcohol, drugs, verdovende middelen of medicijnen die de rijvaardigheid beïnvloeden is ten strengste verboden. Tevens geld er tijdens het gehele evenement een verbod op het gebruik van drugs of verdovende middelen.
9. Rechten van de organisatie
   De organisatie behoudt zich het recht voor om deelnemers te weigeren of te diskwalificeren in geval van:
   onveilig of onverantwoord rijgedrag;
   asociaal of storend gedrag;
   het niet naleven van aanwijzingen van de organisatie.
10. Sponsoruitingen
    Het plakken van sponsorstickers op het deelnemende voertuig is verplicht. Afkoop van deze verplichting is mogelijk tegen een vergoeding van € 750,- exclusief BTW, aan te geven bij de registratie. Indien achteraf blijkt dat de sponsorstickers niet zijn aangebracht, behoudt de organisatie zich het recht voor dit bedrag alsnog in rekening te brengen bij de betreffende deelnemer.
11. COVID-19 maatregelen
    Deelnemers zijn verplicht zich te houden aan de lokaal geldende maatregelen en voorschriften met betrekking tot COVID-19.
12. Afgelasting
    Bij gehele of gedeeltelijke afgelasting van de rally, ongeacht de reden, kan Car & Rally Events niet aansprakelijk worden gesteld. Restitutie van het inschrijfgeld of andere gemaakte kosten is uitgesloten.
13. Beslissingsbevoegdheid
    In gevallen waarin deze voorwaarden niet voorzien, beslist de organisatie. Deelnemers zijn verplicht alle aanwijzingen van de organisatie op te volgen.
14. Beeldmateriaal
    Tijdens de rally worden foto- en video-opnames gemaakt. Deelnemers verklaren zich akkoord dat dit materiaal door de organisatie mag worden gebruikt voor publicatie op sociale media en andere promotionele doeleinden.
15. Leeftijdsgrens
    De minimale leeftijd voor deelname bedraagt 21 jaar.
16. Persoonsgegevens & communicatie
    Deelnemers gaan ermee akkoord dat hun persoonsgegevens (zoals naam en contactgegevens) door de organisatie gedeeld mogen worden met derde partijen die direct betrokken zijn bij de uitvoering van de Road Attack Rally, zoals hotels, restaurants en overige bezochte locaties, voor zover dit noodzakelijk is voor de organisatie van het evenement.
    Daarnaast gaan deelnemers ermee akkoord dat hun naam en telefoonnummer worden toegevoegd aan een WhatsApp-groep waarin ook andere deelnemers aanwezig zijn, uitsluitend ten behoeve van communicatie en coördinatie rondom het evenement.
    De gedeelde gegevens mogen niet door deelnemers of door derden worden gebruikt voor andere doeleinden, zoals reclame, promotie, commercieel gebruik of persoonlijk gewin.
17. Toegang tot evenementen
    Alle evenementen, diners en feesten die onderdeel zijn van de rally zijn uitsluitend toegankelijk voor geregistreerde deelnemers die een persoonlijk toegangsbewijs hebben ontvangen.
18. Annulering
    Annulering is uitsluitend mogelijk tot drie (3) maanden vóór de startdatum van het evenement. Na deze termijn is annulering en restitutie van het deelnamegeld niet mogelijk. Een aanbetaling bij inschrijving wordt in geen geval gerestitueerd.
19. Betaling
    Indien de volledige betaling voor deelname niet uiterlijk op de gestelde vervaldatum is ontvangen, blijft de betalingsverplichting onverminderd bestaan en blijft het volledige verschuldigde bedrag opeisbaar.
20. Persoonlijke inschrijving
    Een inschrijving is persoonsgebonden en niet overdraagbaar.

Deze akkoordverklaring is geldig tijdens de Road Attack Rally georganiseerd door Car & Rally Events. De deelnemer/inschrijver en bijrijder verklaren bij registratie voor het evenement kennis te hebben genomen van de regels en gaat hier mee akkoord.
